Welcome to FaithTrack! These Terms of Use (“Terms”) govern your access to and use of the FaithTrack mobile application (the “App”), provided by Matthew Barber (“we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App. You acknowledge that these Terms are concluded between you and Matthew Barber only, and not with Apple Inc. (“Apple”). Matthew Barber, not Apple, is solely responsible for the App and its content.
You must be at least 13 years old (or the minimum legal age in your country) to use the App. By using the App, you represent and warrant that you meet this age requirement.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.
You may need to create an account to access certain features of the App (e.g., using Email/Password or Google Sign-In). You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary. We reserve the right to suspend or terminate your account if any information provided is inaccurate, untrue, or incomplete, or if you violate these Terms. You are responsible for safeguarding your login credentials. Notify us immediately of any unauthorized use of your account.
FaithTrack Premium is a monthly or annual auto-renewing subscription that provides access to additional spiritual growth modules and enhanced features within the App.
FaithTrack Premium subscriptions are billed and managed through your Apple ID account and are subject to Apple’s In-App Purchase terms. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off in your App Store Account Settings at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription tier. You can manage your subscriptions and turn off auto-renewal by visiting your App Store Account Settings after purchase. Refunds, if any, are handled solely by Apple according to their policies. We reserve the right to change subscription fees upon reasonable notice, subject to App Store policies.

The App may utilize or integrate with third-party services, such as Firebase (for backend infrastructure and authentication), Google Sign-In (for authentication), the Apple App Store (for distribution and In-App Purchases), and may integrate with advertising and analytics services provided by platforms such as Facebook (Meta), TikTok, and Google. Your use of these third-party services may be subject to their respective terms and privacy policies. We are not responsible for the performance, content, or practices of these third-party services.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MATTHEW BARBER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (c) ANY CONTENT OBTAINED FROM THE APP; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to defend, indemnify, and hold harmless MATTHEW BARBER and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; or b) a breach of these Terms.
Matthew Barber is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
You acknowledge that Matthew Barber, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App or the end-user’s possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Matthew Barber, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by deleting the App from your device and discontinuing its use. If you have an active subscription, you must manage its cancellation through your App Store Account Settings. Account deletion features within the app are subject to our account deletion policy (see Privacy Policy and Section 4).
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect, possibly via an in-app notification or by updating the “Last Updated” date. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the App and supersede and replace any prior agreements we might have had between us regarding the App.
